Terms and Conditions for Second-Hand Car Sales




1. Introduction



1.1. Welcome to Eva Auto (“we,” “our,” or “us”). By using our website and purchasing vehicles from us, you agree to abide by the following terms and conditions.

1.2. These terms apply to all visitors, customers, and users of our website and services. If you do not agree with these terms, please refrain from using our website or making a purchase. Eva Auto is the trading name of EVA TECH AUTO LTD.

2. Vehicle Sales & Returns



2.1. All vehicles are sold “as seen” unless otherwise stated. Any warranties provided will be explicitly mentioned at the time of sale.

2.2. If a customer chooses to return a vehicle, a charge of £0.50 per mile for the mileage covered during the ownership period will be deducted from the refund amount.

2.3. An admin fee of £199 will be charged for processing the return.

2.4. The refund will be processed within 7-10 working days and will be transferred to the customer’s bank account.

2.5. The vehicle must be returned in the same condition as at the time of sale, subject to fair wear and tear.

2.6. We reserve the right to decline returns if the vehicle has been modified, misused, or altered in any way.





3. Warranty & Wear-and-Tear Exclusions



3.1. Any provided warranty does not cover general wear-and-tear parts or failures due to misuse, neglect, or lack of proper maintenance.

3.2. The following parts are considered wear-and-tear items and are not covered under any warranty:


  • Clutch & Transmission System: Clutch plate/friction plate, pressure plate, release bearing, flywheel (wear-related failure), clutch cables and hydraulic components (unless a sudden failure occurs), gearbox oil seals (unless leaking due to a manufacturing defect), synchromesh wear in manual gearboxes, automatic transmission fluid degradation.
  • Braking System: Brake pads, brake discs, brake shoes, brake drums, handbrake cables, brake fluid contamination or wear.
  • Suspension & Steering Components: Shock absorbers, coil springs, suspension bushes, track rod ends, ball joints, steering rack gaiters, power steering fluid degradation, anti-roll bar links.
  • Tires, Wheels, and Alignment: Tires (including punctures, sidewall damage, and tread wear), wheel balancing and alignment issues, alloy wheel corrosion or scuffing, TPMS (Tire Pressure Monitoring System) sensor battery depletion.
  • Exhaust & Emissions System: Exhaust pipes, mufflers, catalytic converters (unless defective), diesel particulate filter (DPF) blockage (caused by driving style), EGR valve (excessive carbon buildup due to driving style), oxygen sensors (gradual degradation over time).
  • Battery & Electrical Components: 12V battery (unless found faulty at the time of sale), starter motor degradation due to use, alternator (wear and tear of internal components such as bearings, brushes, and voltage regulators), bulbs and fuses, wiper blades, remote key fob batteries, electric window motors (if failure is due to normal use and not a defect).
  • Engine & Cooling System: Timing belts and chains (unless failure is due to a defect), drive belts and auxiliary belts, spark plugs and glow plugs, air filters, oil filters, fuel filters, coolant hoses, engine mounts (natural rubber wear over time), turbocharger (if failure is due to oil starvation or carbon buildup).
  • Fuel System: Fuel injectors (clogging due to poor fuel quality or use), fuel pump (wear and tear of internal components such as seals, brushes, and motor windings), high-pressure fuel system components (unless a sudden mechanical failure occurs).
  • Interior & Exterior Components: Seats, upholstery, and carpets (general wear and tear), paintwork and body corrosion (unless covered by manufacturer anti-corrosion warranty), door seals and weatherstrips, boot struts (gas struts weaken over time).






4. Limitation of Liability



4.1. We are not responsible for any indirect, incidental, or consequential damages resulting from the use of our vehicles or services.

4.2. Any liability on our part is limited to the value of the purchased vehicle.

4.3. We do not guarantee the availability of any specific vehicle or feature and reserve the right to modify or discontinue our offerings without notice.





5. Privacy & Data Protection



5.1. Any personal information collected through our website or during the sales process will be handled in accordance with our Privacy Policy.

5.2. We do not share customer details with third parties without explicit consent unless required by law.





6. Governing Law & Dispute Resolution



6.1. These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom.

6.2. Any disputes arising under or in connection with these terms shall be resolved through mediation, failing which they shall be subject to the exclusive jurisdiction of the UK courts.





7. Customer Acknowledgment



By purchasing a vehicle from Eva Auto, the customer acknowledges and agrees to these terms and conditions. The customer also acknowledges that the above-listed wear-and-tear items are not covered under any warranty unless a manufacturing defect is proven at the time of sale.
